The following terms are applicable to the use of WhatsApp Connect (the "Service") for electronic communications (herein, "Chat" or "Chats") that you receive from and/or send to CV Advisors®, its officers, employees, duly authorized representatives, or its affiliates (collectively, the "Firm").
By using this Service, you are agreeing to receive communications related to financial-advisory matters from CV Advisors. However, you may opt-out at any time by contacting the Firm's Compliance Team at compliance@cv-advisors.com or by calling (+1) 305 358 5990. Please note, by opting out, you will no longer be able to communicate with CV Advisors using the Service. You may opt back in at any time by contacting the Firm.
Monitoring and Retention
CV Advisors reserves the right, in its sole discretion, and/or as required or permitted by applicable law or regulation, to monitor Chats and to retain all such Chats in a manner and at locations determined by the Firm.
No Liability For Use
Chat messages which request that CV Advisors effect the purchase or sale of any security or commodity, or any other transaction, do not constitute binding instructions, orders, or executions. Orders shall only be deemed received once accepted and processed by the Firm. The Firm has no obligation to enter into a transaction or to provide a quote, based on any such Chat message. Chats must not be used to send or receive transfer instructions, such as Fed Funds wires, or ACH transfer requests of money or securities. CV Advisors does not take any liability or responsibility for any loss or damage that results from using Chats, including but not limited to, such communications having been intercepted, not received, or not acted upon.
Chat Recall Or Deletion
You understand that recall or deletion of any Chat message may not prevent CV Advisors from receiving, viewing, and/or acting on such Chats. Chat recall or deletion does not constitute a valid withdrawal of any request or provision of information. The Firm does not take any liability or responsibility for any loss or damage that results from acting on instructions or requests which were subsequently recalled or deleted.
Responsibility Attributable To You
You are responsible for any transmissions, instructions, authorizations, requests, or other Chats attributable to you, whether entered by you, your authorized personnel, or by any other person. Such Chats shall be deemed to be a duly signed writing of yours and sufficient to bind you.
Information May Not Be Secure
CV Advisors makes no representation or warranty that electronic messages will be confidential. Electronic messages may be intercepted or accessed by unauthorized or unintended parties, may not arrive at the intended destination, or may not arrive in the form transmitted. The Firm can make information available through secure electronic transmissions. Electronic Messages May Be Delayed Or Outdated
The Firm cannot guarantee that Chat communications will be timely, secure, virus, or error free. Information provided is only current at the time it is sent through the Service. The Firm has not undertaken, and will not undertake, any duty to update the information or otherwise advise you of changes in our opinion or in the research or information The Firm makes available to you.
Not Offer Or Solicitation
Chats are not directed to, or to be used or distributed by, any person or entity who is a citizen or resident of, or located in, any locality, state, country, or other jurisdiction where such distribution, publication, availability, or use would be contrary to law or regulation, or which would subject CV Advisors or its affiliates to any registration or licensing requirements, in such jurisdiction. Past performance is no guarantee of future results.
Third Party Data
The data contained in a Chat may be obtained from a variety of sources and may be subject to change. CV Advisors and its affiliates disclaim all liability for the information, including without limitation, any express or implied representations or warranties for information or errors contained in, or omissions from, the information. The Firm and its officers, employees, duly authorized representatives, and affiliates shall not be liable for any loss or liability suffered by you resulting from the provision to you of the information or your use or reliance in any way on the information.
Not Tax Or Legal Advice
CV Advisors does not render advice on tax and tax accounting matters to clients. Chats are not intended or written to be used, and cannot be used, by any taxpayer, for the purpose of avoiding penalties that may be imposed on the taxpayer under U.S. federal income tax laws. Investors should consult their own legal, tax, or other advisors, at both the onset of any transaction, and on an ongoing basis, to determine the laws and analysis applicable to their specific circumstances.
